TERMS AND CONDITIONS
I.) TERMS OF USE:
Definitions:
Individual web sites supported by AdsPayMAX, located in Mohave County, AZ.
End Users:
Are defined as the users of the defined sites that read and review offers for discounted “groucherz.” End Users may purchase one or more “groucherz” in accordance with the Terms and Conditions of Use.
Merchants:
Are defined as the individual businesses that are offering “groucherz” at a discounted rate. Each merchant may have multiple locations or additional Terms and Conditions of Use associated with their “groucherz.” Please refer to the merchants deal for more information.
Groucherz:
A pre paid tender that is used in exchange for goods or services with the offering Merchant. Each “groucher” is subject to its additional Terms and Conditions of Usage as disclosed in the “groucherz” deal. “groucherz” have no cash value and must be redeemed with the offering merchant.
General:
The defined sites provide an online service on the Internet or World Wide Web offering “groucherz” for sale that can be redeemed for goods / services with participating merchants that are featured on the site.
This agreement sets forth the terms and conditions that apply to the use of this site by the End User. The End User agrees to comply with these Terms and Conditions of Use hereof.
The End User acknowledges that there are sometimes interruptions in service that are beyond the control of the defined sites. You understand and acknowledge that due to the circumstances both within and outside the control of the defined sites, the sites may be interrupted, suspended or terminated from time to time. You agree to release the defined sites of any liability or damages arising from the unavailability of the site.
The End User agrees that he or she must be 13 years of age to access the sites, and must be 18 years of age to purchase a “groucher” from the defined sites. Individual “groucherz” may have different age requirements, if any. Please refer to the terms section of each “groucher” to verify age requirements for use, if any.
Copyright:
Everything located on the defined sites is the exclusive property of AdsPayMAX. No part may be used, replicated or duplicated without the express written permission of AdsPayMAX. Copying, posting, distributing, linking, transmitting, or otherwise modifying of these defined sites without the express written consent of the owner is strictly prohibited. Any violation of this policy may result in a copyright or other intellectual property right infringement that may subject the End User to civil and / or criminal penalties.
AdsPayMAX, reserves the right to terminate its agreement with any End User who repeatedly infringes third party copyrights.
Warranty:
The End User expressly agrees that the use of this site is at the End Users sole risk. The defined sites do not make any warranty as to the results that may be obtained from the use of this site. The defined sites do not make any warranty to the reliability of the content / information provided in individual deals when offering groucherz for sale.
Limitation of Liability:
In no event shall the defined sites be liable for any direct, incidental, special, consequential or punitive damages arising out of or related to this agreement. In no event shall the defined sites be held liable for any monetary compensation exceeding the original amount paid for such groucherz.”
Indemnification / Release:
The End User agrees to defend, indemnify and hold harmless the defined sites, their affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorney’s fees arising out of or related to any products or services purchased by the End User in connection with the use of this site.
The End User is solely responsible for interactions with individual merchants and other users of the site. End User hereby releases the defined sites from any and all claims of liability related to any product or service of a merchant.
Third Party Content:
The defined sites are distributers of information and content supplied by third parties and End Users. Accordingly, the defined sites have no editorial control over such content. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, or any other End Users are those of the respective author(s) or distributor(s) and not that of the defined sites.
Arbitration:
By using this site, End User agrees that any claim, dispute, or controversy the End User may have against the defined sites arising out of, relating to, or connected in any way with this agreement, the site, or the purchase or sale of any “groucher(s),” shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association and conducted before a single arbitrator. The arbitration shall be held in Lake Havasu City, AZ and Arizona Law shall be applied.
II.) TERMS OF SALE:
Groucherz:
All groucherz purchased from this site are promotional groucherz that may be purchased for use at participating merchants through the defined sites to be used in exchange for goods and services at a discount from their actual cost. By placing an order for a groucher from a merchant through the defined sites, you make an offer, to purchase the “groucher” on the terms and conditions stated herein. You are required to create an account in order to purchase any “groucher.” This is required so we can provide you with easy access to print your orders, view your past purchases, modify your preferences, and to ensure permissible use of the “groucher.”
The “groucher” you purchase through the defined sites is redeemable for goods or services provided by the merchant. The merchant, not the defined sites, is the seller of the groucher for the goods or services and is solely responsible for redeeming any “groucher” you purchase.
“Groucherz” must be used in a single visit, and do not apply to taxes, tips, shipping and handling, prior balances, and cannot be used in conjunction with any other coupon or offer.
“Groucherz” that are not fully redeemed for their face value are not permitted to be re-used and any unused portion of the “groucher” is forfeited upon submission of the groucher for an order totaling less than the “groucherz” face value.
Reproduction, sale, or any other use not authorized by the defined sites, will render that “groucher” null and void and may render the user liable to legal action.
Any deviations from these terms of sale are at the sole discretion of the issuing merchant.
Refunds:
Refunds are not guaranteed, and your commitment to purchase a “groucher” is legally binding and non-refundable.
Refunds can only be granted by the merchant offering the “groucher.”
Any refunds (if granted) are done so by the merchant and that amount is based on the purchase price, not the face value on the groucher. If a merchant chooses to grant a refund due to a shortage, or unavailability on their part, the refund will be for the full purchase price. If the refund is done as a convenience to the End User due to their inability to use the “groucher,” then the refund will be in the amount of the purchase price less 35%.
Additional Terms and Conditions for Groucherz:
The holder and issuer of a “groucher” is the merchant. As a holder and issuer of the “groucher,” the merchant shall be fully responsible for any and all injuries, damages, claims, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the merchant. You waive and release the owners of the defined sites from any claim, liabilities, damages, or injuries arising from or related to any act or omission of the merchant in connection with your “groucher.”
