End Users:
Are defined as the users of the defined site that read and review advertisements and deals from local merchants. End Users may print FREE ads from the site in accordance with the Terms and Conditions of Use.
Merchants:
Are defined as the individual businesses that are offering “promotions” at a full or discounted rate. Each merchant may have multiple locations or additional Terms and Conditions of Use associated with their “Business.” Please refer to the merchants deal for more information.
General:
The defined site provides an online service on the Internet or World Wide Web offering “Advertising and Discounted Coupon type Deals” for use that can be redeemed for goods / services with participating merchants that are featured on the site.
This agreement sets forth the terms and conditions that apply to the use of this site by the End User. The End User agrees to comply with these Terms and Conditions of Use hereof.
The End User acknowledges that there are sometimes interruptions in service that are beyond the control of the defined site. You understand and acknowledge that due to the circumstances both within and outside the control of the defined site, the sites may be interrupted, suspended, or terminated from time to time. You agree to release the defined site of any liability or damages arising from the unavailability of the site.
The End User agrees that he or she must be 13 years of age to access the site and must be 18 years of age to make a purchase by using a coupon from the defined site.
Copyright:
Everything located on the defined site is the exclusive property of ADSPAYMAX. No part may be used, replicated, or duplicated without the express written permission of ADSPAYMAX. Copying, posting, distributing, linking, transmitting, or otherwise modifying of this defined site without the express written consent of the owner is strictly prohibited. Any violation of this policy may result in a copyright or other intellectual property right infringement that may subject the End User to civil and / or criminal penalties.
ADSPAYMAX, reserves the right to terminate its agreement with any End User who repeatedly infringes third party copyrights.
Warranty:
The End User expressly agrees that the use of this site is at the End Users sole risk. The defined site does not make any warranty as to the results that may be obtained from the use of this site. The defined sitedoes not make any warranty to the reliability of the content / information provided in individual deals when offering ADSPAYMAX.
Limitation of Liability:
In no event shall the defined site be liable for any direct, incidental, special, consequential, or punitive damages arising out of or related to this agreement. In no event shall the defined site be held liable for any monetary compensation exceeding the original amount paid for a discount voucher or an advertisement.
Indemnification / Release:
The End User agrees to defend, indemnify, and hold harmless the defined site, their affiliates and their respective directors, officers, employees, and agents from and against all claims and expenses, including attorney’s fees arising out of or related to any products or services purchased by the End User in connection with the use of this site.
The End User is solely responsible for interactions with individual merchants and other users of the site. End User hereby releases the defined sites from any and all claims of liability related to any product or service of a merchant.
Third Party Content:
The defined site is a distributer of information and content supplied by third parties and End Users. Accordingly, the defined sitehas no editorial control over such content. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, or any other End Users are those of the respective author(s) or distributor(s) and not that of the defined site.
Arbitration:
By using this site, End User agrees that any claim, dispute, or controversy the End User may have against the defined site arising out of, relating to, or connected in any way with this agreement, the site, or the FREE coupons, shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association and conducted before a single arbitrator. The arbitration shall be held in Lake Havasu City, AZ and Arizona Law shall be applied.
II.) TERMS OF USE:
Monthly Deals:
All Deals printed from this site are promotional coupons that may be printed for use at participating merchants through the defined site to be used in exchange for goods and services at a discount from their actual cost. By using a couponat the place of business of a merchant through the defined site, you make an offer, to purchase the “Item/Service on the terms and conditions stated herein. You are required to create an account in order toaccess and print coupons. This is required so we can provide you with easy access to print additional and new coupons, view your past purchases, modify your preferences, and to ensure permissible use of the “Coupons.”
The “Coupons” you print through the defined site are redeemable for goods or services provided by the merchant. The merchant, not the defined site, is the seller of the goods or services and is solely responsible for redeeming any “Coupon” you print.
“Coupons” must be used in a single visit, and do not apply to taxes, tips, shipping and handling, prior balances, and cannot be used in conjunction with any other coupon or offer.
“Coupons” that are not fully redeemed for their face value are not permitted to be re-used and any unused portion of the “Coupon” is forfeited upon submission of the “Coupon” for an order totaling less than the “Coupon” face value.
Reproduction, sale, or any other use not authorized by the defined site, may render that “Deal / Offer” null and void and may render the user liable to legal action.
Any deviations from these terms of sale are at the sole discretion of the issuing merchant.
Additional Terms and Conditions for the AdsPayMAX Coupons
The holder and issuer of any Discount or Coupon is the merchant. As a holder and issuer of the “Deal,” the merchant shall be fully responsible for any and all injuries, damages, claims, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the merchant. You waive and release the owners of the defined site from any claim, liabilities, damages, or injuries arising from or related to any act or omission of the merchant in connection with your “Coupon, Deal or Discount.”
